When someone you love is arrested for a drug offense, the shock often outlasts the arrest itself. Drug charges in California range from a misdemeanor possession citation to a felony transportation case carrying nine years in state prison — and most families don’t know which end of that spectrum they’re on until a bail amount gets set.

In our experience, drug arrests are one of the most emotionally loaded calls we take. There’s shame, there’s fear, there’s confusion about what the charge actually is. We’ve been helping Nevada County families through this exact situation for over 50 years. This post walks through what California law actually says about drug offenses, why our area sees the arrests it does, how bail works, and how we help families get a loved one home.

If you also need to understand DUI-related issues — which sometimes appear alongside drug charges, especially after a traffic stop — see our [**complete guide to DUI arrests and bail bonds in Nevada County**](https://www.nevadacitybail.com/blog/dui-arrests-and-bail-bonds-nevada-county-guide).

We’re at **(530) 265-0535**, 24 hours a day, if you need help right now.

### What California Drug Laws Actually Cover

California’s drug statutes live in the Health and Safety Code and address different conduct depending on *what* the substance is and *what the person was doing with it*.

**Simple possession.** The most common drug arrest. Covers possessing a controlled substance for personal use.

- **HS 11350** — possession of heroin, cocaine, prescription opioids without a valid prescription, and other narcotics
- **HS 11377** — possession of methamphetamine and most psychoactive drugs
- **HS 11357** — possession of cannabis above legal limits, or by someone under 21

Since Proposition 47 passed in 2014, simple possession under HS 11350 and HS 11377 is normally a misdemeanor, even for drugs like heroin and meth. Felony bail still applies if the defendant has to register under PC 290 or has specific prior serious or violent felony convictions.

**Possession for sale.** A step up — the prosecution has to prove the drugs were held with intent to distribute.

- **HS 11351** — possession for sale of heroin, cocaine, prescription narcotics
- **HS 11351.5** — possession for sale of cocaine specifically
- **HS 11378** — possession for sale of methamphetamine
- **HS 11359** — possession of cannabis for sale

These are felonies. Indicators prosecutors use include quantity, packaging, scales, cash, text messages, and the absence of personal-use paraphernalia.

**Sale, transportation, and distribution.** The most serious category.

- **HS 11352** — sale, transportation, or offering to sell most controlled substances
- **HS 11379** — sale or transportation of methamphetamine
- **HS 11360** — sale or transportation of cannabis above legal limits
- **HS 11353 / 11380** — sale, furnishing, or using a minor involving controlled substances (carries significantly higher bail)

Under HS 11352 specifically, prosecutors must prove the defendant transported, sold, or offered to sell the substance; knew the substance was present; knew it was a controlled substance; and that the substance was in fact controlled. Even if no sale was completed, intent to sell or transport can carry the charge.

**Cultivation and manufacturing.**

- **HS 11358** — cultivating cannabis above personal-use limits (over six plants in most cases)
- **HS 11379.6** — manufacturing methamphetamine or other controlled substances
- **HS 11383** — possession of methamphetamine or PCP precursors

### Why Drug Arrests Happen Here

Nevada County and the surrounding area sees a steady volume of drug arrests for a handful of specific reasons:

**Interstate 80 through Truckee.** I-80 is a major east-west corridor between the Bay Area and Reno, and law enforcement treats it as a known trafficking route. Traffic stops that start as a speeding violation routinely turn into drug searches when K-9 units or probable-cause indicators enter the picture. These are some of the highest-bail drug cases we see — often involving defendants from well outside the area.

**Highway 49 and Highway 20.** The two main surface routes through Grass Valley and Nevada City see smaller but regular drug stops, often involving in-area residents during routine traffic enforcement.

**The county’s cultivation history.** Nevada County has a long cannabis cultivation history going back decades, and even after Prop 64 legalized cannabis for adults, cultivation above legal limits — and cultivation on public land — still carries HS 11358 charges. Illegal grow sites found in the foothills periodically produce felony arrests.

**The fentanyl era.** What used to be prescription-pill cases are increasingly fentanyl cases. The quantities involved are smaller, but the legal exposure can be more severe depending on charge selection by the DA.

**Local meth enforcement.** Methamphetamine remains the most common hard-drug substance in our area’s cases. Possession, possession for sale, and transportation charges under HS 11377–11379 all come through the Wayne Brown Correctional Facility regularly.

### Misdemeanor vs Felony Drug Charges

This distinction decides nearly everything about bail and consequences.

**Misdemeanor drug charges and OR releases:** Nevada County releases most cannabis misdemeanors on own recognizance (OR) — no bail required. Other misdemeanor drug charges carry low bail ($2,500 - $5,000).

**Felony drug charges:** Nevada County bail amounts for felony drug cases typically range from the mid five figures into six figures, depending on charges, quantity, and priors ($35,000 - $50,000 base). For felony drug cases, bail may be set by a judge at arraignment rather than automatically from the schedule, especially when quantity or circumstances warrant an enhancement.

#### **Approximate ranges for Nevada County felony drug cases**

*\*Make sure to always verify against current [Nevada County bail schedule](https://www.nevada.courts.ca.gov/forms-filing/fees-bail-schedules)*

**Quantity enhancements raise these dramatically.** Nevada County stacks bail by weight on cannabis and methamphetamine cases:

**Cannabis (HS 11358/11359/11360):**

- Base: $10,000
- 10–50 lbs: **$30,000**
- 50–100 lbs: **$50,000**
- 100+ lbs: **$150,000**

**Methamphetamine (HS 11378–11379.6):**

- Base: $35,000
- More than ½ oz to 2 oz: **$75,000**
- More than 2 oz to 1 lb: **$100,000**
- More than 1 lb to 3 lbs: **$200,000**
- More than 3 lbs to 10 lbs: **$500,000**
- More than 10 lbs: **$1,000,000**

**Using a minor in drug sales (HS 11380):**

- Base: $50,000
- Up to 2 oz: $100,000
- Up to 1 lb: $200,000
- Up to 3 lbs: $400,000
- Up to 10 lbs: $1,000,000
- Over 10 lbs: **$2,000,000**
- PCP involved: additional **+$75,000** under HS 11380.1

#### Aggravating Factors That Raise Bail

Nevada County judges — and the DA’s office when it requests a bail enhancement under PC § 1269c — consider:

- **Quantity.** The single biggest driver, especially for cannabis and meth cases where the schedule bakes weight tiers directly into bail.
- **Prior strikes.** One prior serious or violent felony conviction adds **$25,000** to bail. Two or more strikes add **$150,000**.
- **Unlisted bail enhancements.** When a specific enhancement isn’t listed, Nevada County applies a default **$15,000** enhancement.
- **Involvement of minors.** HS 11353 and HS 11380 carry baseline bail of $50,000 and up — significantly higher than parallel adult offenses.
- **Transportation across county lines.** HS 11352 cases involving movement between counties often draw enhancements.
- **Weapons present during the offense.** A firearm found during a drug arrest almost always triggers additional charges and a bail enhancement.
- **PCP involvement.** Adds $75,000 to HS 11380 cases automatically.
- **Multiple offenses on the same date.** Bail is capped at double the amount for the highest-bail offense.
- **Offenses on separate dates.** Bail is cumulative — each offense date stacks.

### What to Expect After Release

Drug cases usually come with release conditions that are stricter than most other charges. After release on a drug-related bond, expect some combination of:

- **No possession or use of controlled substances** — including no alcohol in many cases
- **Mandatory drug testing** on a scheduled or random basis
- **Court-ordered treatment or counseling** — especially for diversion-eligible cases under PC 1000 or Prop 36
- **Restrictions on contacting known drug users or codefendants**
- **Travel limitations** — in many cases a prohibition on leaving the county without court approval
- **Surrender of passport** in cases involving suspected international trafficking

Attending every court appearance at Nevada County Superior Court in Nevada City is required regardless of where you live. For out-of-area defendants arrested on I-80, this still means returning to Nevada County for court. We make sure every family understands this at the time the bond is posted.

Missing a court date results in a bench warrant, potential bail forfeiture (which puts the cosigner on the hook for the full bail amount), and an additional criminal charge for failure to appear. For drug cases, a violation of the no-use condition can also trigger bail revocation independent of court attendance.

### How Bail Bonds Work for Drug Arrests

The process follows the standard California flow, which you can read all about in our [How Does Bail Work guide](https://www.nevadacitybail.com/blog/how-does-bail-work-in-california). For out-of-area families dealing with a drug arrest on I-80 of a relative who was passing through, we handle the entire process remotely. You don’t need to be in California to get the bond posted.

### FAQ

**How much does a bail bond cost for a drug charge in Nevada County?**
California sets the bail bond premium at 10% of the total bail. A misdemeanor possession case at $5,000 bail runs a $500 premium. A felony possession-for-sale case at $35,000 bail is $3,500. A high-quantity meth transportation case at $100,000 would run $100,000 in premium.

**Is drug possession still a misdemeanor in California after Prop 47?**
Mostly yes. Prop 47 reduced simple possession under HS 11350 and HS 11377 to misdemeanors for most defendants. Felony bail still applies for defendants with PC 290 registration requirements or specific prior serious or violent felony convictions, and for anyone charged with possession *for sale* rather than simple possession.

**What’s the difference between possession and possession for sale?**
Simple possession is personal use. Possession for sale requires prosecutors to prove intent to distribute — usually through quantity, packaging, scales, cash, communications, and the absence of personal-use paraphernalia. The charge selection matters enormously because simple possession is a misdemeanor and possession for sale (HS 11351 or HS 11378) is a felony with $35,000 base bail in Nevada County.

**Why is bail for a Nevada County methamphetamine case sometimes $100,000 or more?**
Because the Nevada County 2026 bail schedule bakes quantity enhancements directly into HS 11378–11379.6 bail. The base is $35,000, but it jumps to $75,000 at a half-ounce, $100,000 at two ounces, $200,000 at a pound, $500,000 at three pounds, and $1,000,000 at ten pounds. Cannabis cases work similarly, scaling from $10,000 base up to $150,000 at 100 pounds.

**Is cannabis cultivation still a crime after Prop 64?**
Adults 21 and older can grow up to six plants for personal use. Cultivation above that threshold is still prosecutable under HS 11358 — as a misdemeanor if the grow is modest, as a felony starting at the $10,000 Nevada County base bail if the quantity triggers felony treatment. Public-land grows and sales-oriented operations are prosecuted more aggressively.

**Can someone be arrested for a drug charge in Nevada County if the drugs came from somewhere else?**
Yes. HS 11352 and HS 11379 cover transportation into, within, or through California. A traffic stop on I-80 near Truckee can result in a Nevada County transportation charge regardless of where the drugs originated.

**Can out-of-area visitors get a bail bond handled by phone?**
Yes. We routinely handle bonds for people arrested while passing through on I-80 whose families are in the Bay Area, Reno, or elsewhere entirely. The entire process — paperwork, payment, posting — happens remotely.

**Will a drug conviction stay on my record forever?**
A misdemeanor possession conviction can usually be expunged under PC 1203.4 once probation is successfully completed. Felony drug convictions are harder to clear but may be eligible for reduction under PC 17(b) if originally charged as a wobbler. Federal immigration consequences — including deportation risk for non-citizens — are separate from the state record and often more severe. For non-citizen defendants, an immigration attorney consult is essential. See our [bail bonds and ICE guide](https://www.nevadacitybail.com/blog/bail-bonds-and-ice-nevada-county-guide) for more.
