# Understanding Sealing vs. Expungement: Clearing Your Criminal Record

People often use "sealing" and "expungement" as if they mean the same thing. In California, they're different tools that apply to different situations and have different effects. Knowing which one fits your record is the first step toward clearing it. Here's a simplified comparison.

### The Short Version

Sealing generally applies to arrests that never led to a conviction. Expungement applies to convictions, after the sentence has been completed. If your case ended without a conviction, sealing is usually the tool to look at. If you were convicted, expungement is usually the starting point.

### Sealing an Arrest Record

When someone was arrested but charges were never filed, the charges were dismissed, or they were acquitted, California law allows them to ask the court to seal the arrest record. In general if charges were never filed, the time limit for filing them has to have passed first. Once a record is sealed, the arrest is generally treated as though it never happened, and the person can usually answer no if a private employer asks whether they've been arrested.

There are exceptions. Sealing can be denied in certain situations, such as some cases involving a pattern of domestic violence, child abuse, or elder abuse, and arrests for offenses with no time limit for charging generally require more. Sealed records can still be seen in some limited circumstances, such as applications to become a police officer.

### Expunging a Conviction

Expungement in California is technically a dismissal. After someone completes probation or their sentence, the court can allow them to withdraw they plea, enter a not guilty plea, and dismiss the case. The conviction isn't erased; it stays in court records but is marked as dismissed. For most private employers, the person can generally say they weren't convicted of that offense.

Expungement has limits. It generally isn't available for state prison sentences or certain serious sex offenses, and a dismissed conviction Amy still need to be disclosed for state licenses, public office, or lat enforcement jobs. It also doesn't restore firearm rights lost because of a felony.

### Side by Side

The clearest way to compare them is to ask three questions. What is it for? sealing is for arrests without a conviction; expungement is for completed convictions. What changes? A sealed arrest is generally treated as though it never occurred; an expunged conviction stays on record but is marked dismissed. Who can still see it? Both are hidden from most private employers, but certain government agencies and licensing boards may still have access, especially with expunged convictions.

### Automatic Relief Is a Third Option

California now grants some relief automatically, without a petition, for many older arrests that didn't lead to a conviction and for some eligible convictions after a period without new offenses. The state adds a notation that limits who can see the record in background checks. It's helpful, but it isn't identical to a court-ordered sealing or expungement, and people aren't notified when it happens, so it's worth checking your record directly.

### Factual Innocence: The Strongest Form of Relief

For someone who was arrested but never committed the crime, California offers a separate process to have a court find them factually innocent. If granted, the arrest records are sealed and eventually destroyed. The standard is high, but for people who qualify, it offers the ostensible complete relief available.

### Which One Is Right for You?

Start by looking at how each case on your record ended. Arrests without a conviction point toward sealing or factual innocence; completed convictions point toward expungement, sometimes along with reducing a felony to a misdemeanor. many people have more than one case and may need more than one tool. A criminal defense attorney or a free clean-slate clinic run by a public defender's office or legal aid group can sort through it with you.

### A Few Common Questions

Is sealing the same as expungement? No. Sealing is generally for arrests without a conviction; expungement is for completed convictions.

Does sealing erase my arrest? Not physically, but a sealed arrest is generally treated as through it never happened for most purposes.

Can an expunged conviction still show up? It can appear in some records, marked as dismissed, and certain agencies can still consider it.

Can I seal a conviction instead of expunging it? In most adult cases, the usual tool for a conviction is expungement, though automatic relief may also apply.

Do I need a lawyer for either one? Not always, but an attorney or legal aid clinic can confirm eligibility and help with the paperwork, often for free.

Clearing a record is one more way to move forward after a hard chapter. Our Nevada City team is available any time day or night, to help with the bail side of things and point you toward the right resources.
